• Contain incomplete or historically inaccurate information

AI outputs are provided for entertainment, informational, artistic, and experiential purposes only.

Historical narratives, timelines, locations, events, and storytelling experiences may contain fictionalized, dramatized, incomplete, or inaccurate elements.

AI generated emotional analysis may be subjective, fictionalized, dramatized, incomplete, or inaccurate.

AI generated voices, narration, cinematic audio, and sound experiences may be synthetic and generated through automated systems.

Apex Obscura LLC does not guarantee the accuracy, completeness, reliability, or historical authenticity of AI generated outputs.

Services provided by Apex Obscura LLC do not constitute:

• Medical advice
• Psychological advice
• Psychiatric advice
• Therapeutic advice
• Legal advice
• Financial advice
• Relationship counseling
• Travel safety advice

Users should not rely upon AI generated outputs as substitutes for licensed professional services.

All decisions made based on generated outputs remain solely the responsibility of the user.

Certain applications may utilize GPS, mapping systems, environmental context, nearby landmarks, or location awareness.

Users acknowledge:

• Routes may become outdated

Users remain fully responsible for complying with traffic laws, safety laws, trespassing laws, and local regulations.

Users are solely responsible for evaluating environmental safety, weather conditions, road conditions, trespassing restrictions, accessibility conditions, and surrounding hazards.

Services are not intended for emergency navigation, rescue operations, law enforcement reliance, disaster response, or safety critical decision making.

Users must not interact with applications while operating vehicles in violation of applicable laws.

Drivers must remain attentive to road conditions at all times.

• Do not use applications while distracted driving
• Passengers should handle device interaction whenever possible
• Always prioritize road safety
• Never rely upon AI narration or generated content for emergency or safety critical decisions

Apex Obscura LLC is not responsible for accidents, injuries, unsafe driving behavior, navigation related incidents, environmental hazards, or travel related outcomes.

Applications may offer:

• Free usage tiers
• Premium subscriptions
• Recurring billing
• One time purchases
• Usage based systems
• In app purchases

Subscriptions automatically renew unless canceled before renewal dates.

Billing and refunds may be governed by Apple App Store policies, Google Play policies, Stripe policies, or other platform provider policies.

Except where required by law or applicable platform policy, purchases, subscriptions, credits, and virtual purchases are non-refundable.

If users access or purchase services through Apple App Store, Google Play, Stripe, or any other third party platform, users acknowledge that additional platform terms may apply.

Apple, Google, Stripe, and other platform providers are not responsible for maintaining, supporting, warranting, or resolving claims related to Apex Obscura LLC services unless required by their own policies or applicable law.

For iOS applications, users acknowledge that Apple and its subsidiaries may be third party beneficiaries of these Terms where required by Apple platform rules.

Users are responsible for managing subscriptions, cancellations, renewals, and refund requests through the applicable platform provider.

Certain applications may include virtual credits, cinematic unlocks, premium interactions, AI generation credits, and other virtual purchases.

Virtual purchases:

• Have no cash value
• Are non-transferable
• Are non-refundable unless required by law
• May expire or change over time
• May be modified, limited, revoked, or discontinued at any time

Apex Obscura LLC reserves the right to modify pricing structures, usage systems, credit allocations, subscription models, feature availability, and virtual systems at any time.

All applications, software, branding, visuals, interfaces, AI systems, audio, cinematic assets, code, and content developed by Apex Obscura LLC remain the exclusive property of Apex Obscura LLC.

Users may not:

• Copy content
• Modify services
• Republish material
• Commercialize assets
• Redistribute content

Users retain ownership of original content submitted where applicable.

By submitting prompts, suggestions, reviews, messages, or media, users grant Apex Obscura LLC a worldwide, non-exclusive license to use, process, display, and improve the services.

We reserve the right to remove content violating these Terms.

Use of beta features occurs at the user’s own risk.

To the fullest extent permitted by law, services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

• Historical accuracy
• Emotional outcomes
• Relationship outcomes
• Navigation accuracy
• AI output reliability
• Continuous platform availability

To the fullest extent permitted by law, Apex Obscura LLC shall not be liable for:

• Emotional distress
• Psychological impact
• Relationship decisions
• Travel incidents
• Navigation errors
• AI inaccuracies
• Historical inaccuracies
• Financial loss
• Business interruption
• Indirect damages
• Consequential damages
• Punitive damages

Total aggregate liability shall never exceed the greater of $100 USD or the amount paid by the user during the prior twelve months.

Users voluntarily assume all risks associated with use of the services including travel, exploration, emotional analysis, suspense themed experiences, cinematic narration, AI generated outputs, and location based interactions.

Users should always exercise independent judgment and comply with all local laws and safety practices.

Users agree to defend, indemnify, and hold harmless Apex Obscura LLC from claims arising from:

• Misuse of services
• Violation of these Terms
• Illegal activity
• User generated content
• AI generated outputs
• Travel decisions
• Third party interactions

Users agree that disputes shall be resolved exclusively through binding arbitration.

Users waive:

• Jury trials
• Class action lawsuits
• Class wide arbitration
• Representative claims

Arbitration shall occur individually only.

Claims must be brought within one year.

Users consent to electronic agreements, electronic disclosures, and electronic records.

Selecting buttons such as “Accept,” “Continue,” “Subscribe,” or “Purchase” constitutes legally binding electronic acceptance.

Users may not access, export, re-export, or use the services in violation of applicable United States export control laws, sanctions laws, or trade restrictions.

Users represent that they are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive sanctions where use of the services would be prohibited by law.

Apex Obscura LLC shall not be liable for delays or failures caused by events beyond reasonable control including:

• Infrastructure outages
• Natural disasters
• Internet failures
• Governmental actions
• Third party outages

Use of services is also governed by the Apex Obscura LLC Privacy Policy.

Apex Obscura LLC reserves the right to suspend or terminate services at any time for violations of these Terms or misuse of the platform.

These Terms shall be governed by and interpreted under the laws of the State of Michigan, without regard to conflict of law principles.

Claims arising from use of the services must be brought within one year after the event giving rise to the claim.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain enforceable.

These Terms constitute the complete agreement between users and Apex Obscura LLC regarding use of the services.

All rights not expressly granted herein are reserved by Apex Obscura LLC.

Apex Obscura LLC may update these Terms at any time.

Continued use of services after updates constitutes acceptance of revised Terms.
